First Ontario decision to apply the newly formulated Van Breda test for jurisdiction (not)

At first glance, the recent decision in Branconnier v. Maheux, 2010 ONSC 1524 (CanLII) (March 11, 2010 per Gordon, J.) holds promise as the first to apply the “Van Breda test” for jurisdiction simpliciter : Van Breda v. Village Resorts Limited, 2010 ONCA 84, which modified, or, arguably, transmogrified the “real and substantial connection” test and Muscutt factors. Regrettably, the motion judge applied the old Muscutt factor analysis, so it is reasonable to assume that the decision will be appealed.
